Buffalo 1 Year Extended Warranty Terms and Conditions
This extended warranty covers the hardware product with serial number specified overleaf (the Product) for a period of one year commencing on the expiry of Buffalo's standard 3 year limited warranty given by Buffalo's reseller (the Extended Warranty Period), subject always to the customer completing registration of the extended warranty using the form overleaf within 60 days of the Warranty Purchase Date. Buffalo warrants that, during the Extended Warranty Period, the Product (excluding software and consumables) will be free from material defects, provided that:
the Product has been used strictly in accordance with the specification issued by the manufacturer of the product into which the Product has been incorporated and in accordance with any documents supplied with the Product;
the customer has provided Buffalo with written notice of the defect no later than 30 calendar days from discovery of the defect
neither the customer nor any third party end user (unless authorised by Buffalo) has replaced parts, maintained, altered, modified, adjusted or repaired the Product; and all Products have been properly maintained in accordance with all reasonable instructions, pamphlets or directions given or issued by Buffalo from time to time;
the customer has not removed any identification marks from the Product; and
Buffalo has received all monies due from the customer in relation to the Product.
In the event of any breach of the above warranty during the Extended Warranty Period, Buffalo's liability is limited to the obligation to refund or replace the affected Product. Where the customer wishes to return any Product under this extended warranty, it is required to submit a request by email, fax or online (where available) using Buffalo's return request form. Buffalo will consider the application and shall either authorise or decline the request within 5 business days of its receipt.Buffalo may at its discretion request Products for evaluation and/or a technical report pending authorisation; supply the customer with any part necessary to rectify the defect; and/or issue a compulsory request for the faulty Product to be disposed of, or recalled in line with quality control standard IS0 9001:2000.Where Buffalo authorises a return, it will provide the customer with a return authorisation number, valid for 15 days from the date of issue, and will confirm whether the Product has been accepted for repair, replacement (of all or any part), a refund or such other remedy as may be agreed in the circumstances.All returns shall be at the customer's expense to the agreed address and the customer shall be responsible for ensuring that:
all Products are returned in appropriate packaging, free from material damage with the returns authorisation clearly displayed. Failure to do so may voidany warranty in respect of the Product and Buffalo reserves the right to return such Products at the customer expense;
adequate shipping documents are enclosed with the Product quoting the return authorisation number; and all freight and other duties are paid in full bythe customer; and
only Products authorised under the return authorisation number are returned.
In the event of any material discrepancy the Product may be rejected by Buffalo at its sole discretion and returned at the customer's expense.Nothing in this extended warranty shall operate to limit or exclude either party's liability for death or personal injury caused by its negligence, or for any fraudulent misrepresentation. Subject to the above, Buffalo will not be liable to the customer for any of the following losses howsoever arising: any loss of or destruction of data or any reconstitution thereof; any loss of anticipated profits or expected future business; damage to reputation or goodwill; any damages costs or expenses payable by the customer to any third party; loss of any order or contract; or any consequential indirect or special losses of any kind.
The liability of Buffalo in respect of all loss or damage suffered by the customer during the Extended Warranty Period shall be limited to the reasonable cost of remedying any defect in the Product or other matter constituting a breach and in no circumstances shall Buffalo's liability exceed €10,000. No action in any form arising out of this extended warranty shall be instituted more than 24 months after the cause of action has arisen.
